Here's something American media are virtually guaranteed to not report: a British court has determined that Al Gore's schlockumentary "An Inconvenient Truth" contains at least eleven material falsehoods.
It seems a safe bet Matt Lauer and Diane Sawyer won't be discussing this Tuesday morning, wouldn't you agree?
For those that haven't been following this case, a British truck driver filed a lawsuit to prevent the airing of Gore's alarmist detritus in England's public schools.
According to the website of the political party the plaintiff, Stewart Dimmock, belongs to (ecstatic emphasis added throughout, h/t Marc Morano):
In order for the film to be shown, the Government must first amend their Guidance Notes to Teachers to make clear that 1.) The Film is a political work and promotes only one side of the argument. 2.) If teachers present the Film without making this plain they may be in breach of section 406 of the Education Act 1996 and guilty of political indoctrination. 3.) Eleven inaccuracies have to be specifically drawn to the attention of school children.
How marvelous. And what are those inaccuracies?
- The film claims that melting snows on Mount Kilimanjaro evidence global warming. The Government's expert was forced to concede that this is not correct.
- The film suggests that evidence from ice cores proves that rising CO2 causes temperature increases over 650,000 years. The Court found that the film was misleading: over that period the rises in CO2 lagged behind the temperature rises by 800-2000 years.
- The film uses emotive images of Hurricane Katrina and suggests that this has been caused by global warming. The Government's expert had to accept that it was "not possible" to attribute one-off events to global warming.
- The film shows the drying up of Lake Chad and claims that this was caused by global warming. The Government's expert had to accept that this was not the case.
- The film claims that a study showed that polar bears had drowned due to disappearing arctic ice. It turned out that Mr Gore had misread the study: in fact four polar bears drowned and this was because of a particularly violent storm.
- The film threatens that global warming could stop the Gulf Stream throwing Europe into an ice age: the Claimant's evidence was that this was a scientific impossibility.
- The film blames global warming for species losses including coral reef bleaching. The Government could not find any evidence to support this claim.
- The film suggests that the Greenland ice covering could melt causing sea levels to rise dangerously. The evidence is that Greenland will not melt for millennia.
- The film suggests that the Antarctic ice covering is melting, the evidence was that it is in fact increasing.
- The film suggests that sea levels could rise by 7m causing the displacement of millions of people. In fact the evidence is that sea levels are expected to rise by about 40cm over the next hundred years and that there is no such threat of massive migration.
- The film claims that rising sea levels has caused the evacuation of certain Pacific islands to New Zealand. The Government are unable to substantiate this and the Court observed that this appears to be a false claim.
In the end, a climate change skeptic in the States must hope that an American truck driver files such a lawsuit here so that a U.S. judge can make similar determinations.
Of course, even if one could find such an impartial jurist, our media wouldn't find it newsworthy, would they?

I must admit that I have been rather pleasantly surprised at the hostile reaction that St. Albert and his Church of AGW has been encountering in some parts of the globe. Particularly in GB.
Who knows? There just may be hope for that island nation yet.
As for someone here filing a similar legal action (and I would love to see it), I don't really think it would fly. There are just too many dem-appointed/dem elected jurists who are tithing members and/or deacons of the Church of AGW.

Below is an excerpt of my response to the school. I guess I need to get the English truck driver's phone number and see the secret to his success. Unfortunately, battling these issues takes time...a lot of time.
Although I am a Professional Environmental Engineer, I admit that I am not an expert on the issue of global warming. However; to borrow words from someone else, I support the principle that young people should be educated, not propagandized -- and I know something about what that means.
One of the most important differences between education and propaganda is how they deal with great controversies.
In education, students are taught about the controversies. In propaganda, they are shielded from them.
In education, students are taught both sides of the important debates. In propaganda, they are taught only one.
In education, students are taught both the strengths and the weaknesses of the officially favored theory. In propaganda, they are taught only its strengths.
In short, education is the training of minds, while propaganda is the training of prejudices. In a democratic republic, the public schools should not propagandize, but educate.
The mandatory curriculum guidelines for Texas, called Texas Essential Knowledge and Skills (TEKS), agree with me. As we find in the science section of these guidelines, students must learn to "analyze, review, and critique scientific explanations, including hypotheses and theories, as to their strengths and weaknesses using scientific evidence and information." - 19 TAC Chapter 112.7(b)(3)(a)
If the TEKS guidelines agree with me, then what is the issue? The issue is that although students should be taught about both sides of a scientific theoretical controversy, your assignment, based on the description in your permission request, appears to only present one side and are shielded from the weaknesses contained in Al Gore’s video. How can a 5th grade student write a critique about assertions made in a global warming video without having anything to compare and contrast the assertions to? Your permission/assignment sheet gave no indication as to how, if any, the views counter to Al Gore’s video would be taught. In addition, it is not clear what alternate assignment is available to the student should they choose not to view the video.
If the theory of global warming is to be taught in your classroom, I urge that the topic should be taught like the other sciences and like other controversial theories -- with honesty about both sides.
To the Honorable members of the Board:
When classroom activities and/or textbooks are biased, you (and the Texas Education Agency) are the check and balance. If global warming is to be taught within PISD, I urge you to require that the scientific data to both sides of this controversy be taught and that not one side be suppressed. To do so would be not only good training in science, but good education in citizenship.

We have schools around Atlanta in which the government agents (teachers) who run them collect every student's school supplies when they show up on the first day, then re-distribute them equally among all the students.
After all, it just isn't fair for some students to have more, or nicer stuff, than others.

The truth ice core samples show that C02 follows temperature by 800 or more years not the other way around as claimed by Gore and the global warming worshipers. To believe current anthropologic global warming you would have to believe that temperature follows C02 and the ice samples show that is not true. It also is the reason that highly respected Scientists are leaving the IPCC.

The scientific arguments presented in The Great Global Warming Swindle can be stated quite briefly:
1. There is no
proof that the current warming is caused by the rise of greenhouse
gases from human activity. Ice core records from the past 650,000 years
show that temperature increases have preceded—not resulted from—increases in CO2 by hundreds of years, suggesting that the warming of the oceans is an important source
of the rise in atmospheric CO2. As the dominant greenhouse gas, water
vapor is far, far more important than CO2. Dire predictions of future
warming are based almost entirely on computer climate models, yet these
models do not accurately understand the role or water vapor—and, in any
case, water vapor is not within our control. Plus, computer models
cannot account for the observed cooling of much of the past century
(1940–75), nor for the observed patterns of warming—what we
call the “fingerprints.” For example, the Antarctic is cooling while
models predict warming. And where the models call for the middle
atmosphere to warm faster than the surface, the observations show the
exact opposite.
The best evidence supporting natural causes
of temperature fluctuations are the changes in cloudiness, which
correspond strongly with regular variations in solar activity. The
current warming is likely part of a natural cycle of climate warming
and cooling that’s been traced back almost a million years. It accounts
for the Medieval Warm Period around 1100 A.D., when the Vikings settled
Greenland and grew crops, and the Little Ice Age, from about 1400 to
1850 A.D., which brought severe winters and cold summers to Europe,
with failed harvests, starvation, disease, and general misery. Attempts
have been made to claim that the current warming is “unusual” using
spurious analysis of tree rings and other proxy data. Advocates have
tried to deny the existence of these historic climate swings and claim
that the current warming is "unusual" by using spurious analysis of
tree rings and other proxy data, resulting in the famous “hockey–stick”
temperature graph. The hockey-stick graph has now been thoroughly
discredited.
2. If the cause of warming is mostly
natural, then there is little we can do about it. We cannot control the
inconstant sun, the likely origin of most climate variability. None of
the schemes for greenhouse gas reduction currently bandied about will
do any good; they are all irrelevant, useless, and wildly expensive:
Ironically, even if
CO2 were responsible for the observed warming trend, all these schemes
would be ineffective—unless we could persuade every nation, including
China, to cut fuel use by 80 percent!
3. Finally, no
one can show that a warmer climate would produce negative impacts
overall. The much–feared rise in sea levels does not seem to depend on
short–term temperature changes, as the rate of sea–level increases has
been steady since the last ice age, 10,000 years ago. In fact, many
economists argue that the opposite is more likely—that warming produces
a net benefit, that it increases incomes and standards of living. Why
do we assume that the present climate is the optimum? Surely, the
chance of this must be vanishingly small, and the economic history of
past climate warmings bear this out.
But the main message of
The Great Global Warming Swindle is much broader. Why should we devote
our scarce resources to what is essentially a non–problem, and ignore
the real problems the world faces: hunger, disease, denial of human
rights—not to mention the threats of terrorism and nuclear wars? And
are we really prepared to deal with natural disasters; pandemics that
can wipe out most of the human race, or even the impact of an asteroid,
such as the one that wiped out the dinosaurs? Yet politicians and the
elites throughout much of the world prefer to squander our limited
resources to fashionable issues, rather than concentrate on real
problems. Just consider the scary predictions emanating from supposedly
responsible world figures: the chief scientist of Great Britain tells
us that unless we insulate our houses and use more efficient light
bulbs, the Antarctic will be the only habitable continent by 2100, with
a few surviving breeding couples propagating the human race. Seriously!

Great fan of private property rights?
October 17, 2007 - 11:27 ET by NL207Not hardly. You unformly favor measures that place private property in general and in particlar the means of production under the preemptive control of the state. The economic model you have repeatedly and consistently favored whether the subject is energy supplies as here or health care service and pharmacuticals in other threads, is thinly veiled facsim: i.e. state control of privately owned means of production.
Let me address you SO2 cap-and-trade comments in spite of the segue they represent. The economic damage from this program has been staggering. This quote: "national cap and trade program" should give a clue as to why. The program only operates within the US. This congressional report from 1997 even mentions this 'problem'. China, Russia and India are entirely exempt [as is everone else] and China is by far largest SO2 polluter in the world. In 2000, Chuna released twice the SO2 the United States did. Russia and India together released just as much. The costs that China saved by ignoring SO2 emissions have significantly added to the already imposing comeptitive advantages they enjoy over US made goods in many markets. This has contributed materially and significantly to the enormous balance of payments deficit that exists with China.
In short, SO2 cap-and-trade has seriously undermined our competitive stance vs the PRC. People are losing jobs and prosperity here in the US because of this.

Property rights and cap and trade have nothing to do with The Great Global Warming Swindle. I am for private property rights and against cap and trade schemes.

- "the [government] understandably formed the view that AIT was an outstanding film, and that [high] schools should be enabled to show it to pupils"?
- "The following is clear:
i) [An Inconvenient Truth] is substantially founded upon scientific research and fact, albeit that the science is used, in the hands of a talented politician and ommunicator, to make a political statement and to support a political programme"?
ii) “The Film advances four main scientific hypotheses, each of which is very well supported by research published in respected, peer-reviewed journals and accords with the latest conclusions of the IPCC:
(1) global average temperatures have been rising significantly over the past half century and are likely to continue to rise (“climate change”);
(2) climate change is mainly attributable to man-made emissions of carbon dioxide, methane and nitrous oxide (“greenhouse gases”);
(3) climate change will, if unchecked, have significant adverse effects on the world and its populations; and
(4) there are measures which individuals and governments can take which will help to reduce climate change or mitigate its effects”?
"These propositions ... are supported by a vast quantity of research published in peer-reviewed journals worldwide and by the great majority of the world’s climate scientists"?

- I have no doubt that [the government`s] expert, is right when he says that: “Al Gore’s presentation of the causes and likely effects of climate change in the film was broadly accurate?
- However, "There are errors and omissions in the film ... and respects in which the film, while purporting to set out the mainstream view ... does in fact itself depart from that mainstream, in the sense of the “consensus” expressed in the IPCC reports." ... It was essential to appreciate that the hearing before me did not relate to an analysis of the scientific questions, but to an assessment of whether the ‘errors’ in question, set out in the context of a political film, informed the argument [as to whether presentation of the film in schools is impermissibly political]"?
- The film can be presented, if the government provides to teachers a "Guidance Note" drawing specific attention to where Mr Gore may be in error and/or in any event where he deviates from the consensus view as set out in the IPCC report, and by, where appropriate, raising specific questions for discussions?

I find it hard to believe that Marc Morano can be so ecstatic about this decision - if he has actually bothered to read or understand it. But I do suppose that yes, impartial jurists could be found in the US to make similar decisions supporting showing of AIT in public schools. Maybe that`s why the US press didn`t find the decision particularly newsworthy - because they share your view that the British judge was right?
BTW, you might note that there are good arguments that judge was a bit off in his judgment of points where AIT differs from the IPCC: http://scienceblogs..... But in any case, I am happy to see that you agree witht the judge`s choice of the IPCC reports as the standard against which semipolitical films like AIT should be measured. How would "Swindle" hold up?

This isn't the first time you've posted a lengthy attempt to discredit an article or author many days after it was originally posted and quite subsequent to the piece being anywhere near the website's front page. If your goal is to get the final word, you're accomplishing such. If you actually want to evoke discussion, this is a poor strategy at best.
Furthermore, given that this story is now a week old, it seems similarly valueless for me to waste much time responding, as likely no one will see it -- maybe not even you.
That said, to answer your question simply, I would LOVE for a U.S. judge to offer this opinion, for it would REQUIRE that ANY showing of this film in American public schools had to include a disclaimer about its political nature, and its errors. This would be a HUGE improvement versus what is currently transpiring in our nation. ns

October 16, 2007 - 13:36 ET by BlindSightin a particular school district or state at the most, but a decision like this would probably help Gore`s case - particularly as it`s getting easier all the time to see that the IPCC has been too conservative in underestimating the pace of change. That`s why guys like Michaels are starting to throw in the towel and argue straight policy - that there`s little we can do so we might as well start getting ready.
Of course what would really help the schools would be for the federal government to get out of trying to dictate to them, so there would be less politicization.
